1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Kindness Home Care Services LLC website (the "Site") and any services provided by Kindness Home Care Services LLC ("Company," "we," "our," or "us"). By accessing this Site or engaging our services, you ("Client," "Applicant," or "User") agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use our website or services. These Terms constitute a legally binding agreement between you and the Company.
These Terms apply to your use of our public website, care request forms, contact forms, newsletter sign-up forms, job application forms, resume uploads, and any follow-up communication submitted through those channels.
2. Description of Services
Kindness Home Care Services LLC provides private pay in-home care services in Columbus, Ohio and surrounding areas. Our services include, but are not limited to: 24-hour live-in care, companionship, errands and daily help, cooking and grooming assistance, State Tested Nursing Assistant (STNA) care support, and daily living assistance.
All services are provided on a private pay basis. We are not a Medicare or Medicaid provider. We do not provide medical diagnosis, medical treatment, or nursing services beyond the scope of STNA certification.
Information submitted through this website is used to help us review care requests, answer inquiries, evaluate job candidates, and respond to newsletter sign-ups. Submitting a form does not create a caregiver-client relationship, employment relationship, or guarantee that services or employment will be offered.
The scope of services available to a specific client is determined through an individualized care plan established prior to the start of services. We reserve the right to modify, expand, or discontinue any service at any time with appropriate notice.
3. Service Agreement
Prior to the commencement of services, each client or authorized representative will be asked to sign a Service Agreement that details:
- The specific services to be provided
- The agreed-upon schedule and caregiver assignment
- Billing rates and payment terms
- Cancellation and modification procedures
- Client and Company responsibilities
- Procedures for reporting concerns or incidents
The Service Agreement supplements these Terms. In the event of a conflict between the Service Agreement and these Terms, the Service Agreement shall govern with respect to the specific services being provided.
Website forms are for intake and communication purposes only. Final care schedules, billing commitments, caregiver assignments, and service obligations are created only through the separate Service Agreement and related written confirmations.
4. Payment Terms
Services are billed on a weekly or bi-weekly basis, as agreed in the Service Agreement. Payment is due upon receipt of invoice. Accepted payment methods include check, Zelle, ACH bank transfer, and major credit or debit cards. A processing fee may apply to card payments.
Accounts that remain unpaid beyond 15 days from the invoice date may be subject to a late fee as specified in the Service Agreement. The Company reserves the right to suspend services for accounts that are more than 30 days past due, after notice to the client.
All rates are subject to change. Clients will be provided at least 14 days' written notice before any rate increase takes effect.
Pricing information displayed on the website is informational only unless expressly incorporated into a signed written agreement. Quotes, care needs, and staffing requirements may affect final rates.
5. Cancellation and Modification of Services
Either party may terminate the service relationship by providing written notice as specified in the Service Agreement (typically 7–14 days). The Company may terminate services immediately in cases involving client or household behavior that poses a risk to caregiver safety, non-payment, or material breach of the Service Agreement.
For individual visit cancellations, clients are requested to provide at least 24 hours' advance notice. Visits cancelled with less than 24 hours' notice may be billed at the rate specified in the Service Agreement.
We understand that emergencies arise. Cancellation fees related to genuine medical emergencies or hospitalizations will be waived at our discretion.
6. Client and Household Conduct
Clients and household members are expected to treat caregivers with dignity and respect at all times. The following behaviors are not permitted and may result in immediate termination of services:
- Physical, verbal, or emotional abuse or harassment of caregivers
- Requests that caregivers perform tasks outside the agreed care plan or outside their scope of practice
- Solicitation of caregivers for private employment outside of Kindness Home Care
- Discrimination based on race, national origin, religion, gender, age, or disability
- Any unsafe or threatening environment
Clients are responsible for ensuring a safe working environment for caregivers, including maintaining a smoke-free environment when requested, securing pets, and ensuring the home is free of hazards.
7. Caregiver Employment and Non-Solicitation
All caregivers placed by Kindness Home Care Services LLC are employees of the Company. Clients agree not to hire or solicit the services of any caregiver introduced through the Company for a period of twelve (12) months following the termination of services, without prior written consent from the Company and payment of a referral fee as specified in the Service Agreement.
If you wish to hire a caregiver directly, please contact our office to discuss a referral arrangement.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Kindness Home Care Services LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services or this website.
Our total liability to any client for any claim arising from or related to services provided shall not exceed the total amount paid by the client in the 30 days preceding the event giving rise to the claim.
We do not guarantee specific outcomes of care. Results may vary based on the individual client's condition, cooperation, and other factors outside our control.
The Company is not liable for losses caused by events outside our reasonable control, including natural disasters, power outages, severe weather, public health emergencies, or other force majeure events.
9. Website Use and Conduct
You agree to use this website only for lawful purposes. You may not:
- Use the site in any way that violates applicable local, state, or federal laws
- Transmit unsolicited commercial communications
- Attempt to gain unauthorized access to any part of the site or its related systems
- Use automated tools to scrape, crawl, or harvest information from the site
- Submit false, misleading, fraudulent, or incomplete information through any form on the site
- Upload malicious files, harmful code, or documents you do not have the right to share
- Use the forms to send material that is unlawful, abusive, threatening, defamatory, discriminatory, or invasive of another person's privacy
We reserve the right to terminate or restrict access to the site for any user who violates these conditions.
We may remove, ignore, or refuse to act on any submission that appears fraudulent, incomplete, unsafe, or outside the intended purpose of the website.

All content on this website, including text, graphics, logos, icons, and layout, is the property of Kindness Home Care Services LLC or its content providers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.
You may not use our business name, trade dress, branding, service descriptions, images, or logos in a way that suggests endorsement, partnership, or affiliation without our prior written consent. You also may not copy or republish content from this website for commercial use without permission.
If you submit materials to us, including resumes or application documents, you represent that you have the right to share those materials and that doing so does not infringe the intellectual property, privacy, or contractual rights of any third party.
11. Dispute Resolution
We encourage clients to contact us directly with any concerns before pursuing formal dispute resolution. Most issues can be resolved quickly through a conversation with our management team.
For disputes that cannot be resolved informally, the parties agree to attempt mediation in Franklin County, Ohio before initiating legal proceedings. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in Franklin County, Ohio in accordance with the rules of the American Arbitration Association, unless both parties agree to an alternative process.
Notwithstanding the above, either party may seek emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Franklin County, Ohio.
13. Modifications to These Terms
We reserve the right to modify these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Material changes will be communicated to active clients by email with reasonable advance notice. Your continued use of the site or services after the effective date of changes constitutes acceptance of the revised Terms.
If you object to any change, your remedy is to discontinue use of our services and provide the required notice of termination as described in your Service Agreement.
